Pass Drive Terms and Conditions

1.Legal:

1.1 Pupils must be of legal age to drive and produce a valid UK/ Northern Ireland provisional category B photo card driving licence. For motorway, Pass Plus or refresher lessons a full valid licence must be produced with photographic identification if the old style paper licence is held.

1.2 You must declare any points or driving convictions prior to tuition commencing.

1.3. You must notify your instructor of any change of your ability to have driving tuition, for example if your provisional licence has been revoked or for medical reasons suspended.

1.4. You must meet the minimum eye test requirements which require you to be able to read a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet). If you need to wear glasses or contact lenses in order to meet this requirement then you must wear them whenever you drive.

1.5. You must not be under the influence of alcohol/drugs during training. If your instructor detects signs of alcohol/drugs misuse, he/she will withhold the use of the training vehicle for tuition or driving test until you are in a legal and fit state to drive.

1.6 Prescribed medication may also affect your driving. It is your responsibility to check the instructions or ask your pharmacist.

2. Lessons and payments:

2.1 Your instructor will endeavour to arrive on time however, due to unforeseen circumstances such as breakdowns, accidents, traffic holdups etc, lesson times may need to change or even be cancelled. If cancelled by your instructor, no fee will be charged.

2.2 If your instructor turns up on time at the pre-arranged pick up point and you do not show, your instructor will wait 10 minutes and if there is no contact made between you after 10 minutes the instructor will leave and you will have to pay in full for the lesson.

2.3 Lessons can be paid for in advance by bacs, debit/credit card, through our website; or by card payment over the phone. Alternatively, cash payments are accepted in the car prior to lessons commencing (This only applies to lessons with self-employed Pass Drive instructors, please see section 2.7 for further details on employed driving instructors). Cheques are no longer accepted. (Please see further terms for intensive or residential courses)

2.4 Where discounts are offered for block bookings, these must be paid in advance either to Pass Drive by bacs/card or cash direct to your instructor.

2.5 Block booked lessons cancelled before completion will incur an admin charge of £10. Lessons already taken within this block will be charged at the current single lesson rate per/hour.

2.6 Introductory offers are for beginners or pupils with less than 10 hours of driving experience.

2.7 Lessons with driving instructors who are employed by Pass Drive (Employed instructors can be identified by their liveried vehicles and they will inform you of this prior to your lessons commencing. You will also complete the New Pupil Start Form when learning with an employed Pass Drive Driving Instructor:

2.7.1 Your instructor will endeavour to arrive on time however, due to unforeseen circumstances such as breakdowns, accidents, traffic holdups etc, lesson times may need to change or even be cancelled. If cancelled by your instructor, no fee will be charged.

2.7.3 Lessons can be paid for in advance by bacs, debit/credit card, through our website; or by card payment over the phone. Lessons should be paid 1 week prior to the arranged lesson date. If you do not pay for your driving lesson 1 week prior to the arranged lesson date, you will forfeit this lesson slot. (Please see further terms for intensive or residential courses).

2.7.4 Where discounts are offered for block bookings, these must be paid in advance to Pass Drive by bacs/card.

2.7.5 Block booked lessons cancelled before completion will incur an admin charge of £10. Lessons already taken within this block will be charged at the current single lesson rate per/hour.

Cancellations:

2.8 48 hours notice must be given if you wish to cancel or rearrange a lesson. This is to give the instructor time to fill this slot. Full payment for the lesson will be due if less than 48 hours notice is given.

3. Instructors:

3.1 Your instructor is a self employed agent unless otherwise stated, and after initial contact, your contract is directly with the instructor and not Pass Drive, except where a residential or intensive course is booked. If your instructor is employed by Pass Drive, you will be notified prior to your lessons commencing and you will complete a New Pupil Start Form; by signing you are agreeing to these Terms and Conditions. In this instance, your contract will be with Pass Drive.

3.2 Self-employed instructors may display their own brand. This is because they have been subcontracted by Pass Drive to deliver training on our behalf. Instructors who are employed by Pass Drive will have liveried vehicles displaying Pass Drive’s unique branding.

3.3 If for any reason you are unhappy with your allocated instructor, we will endeavor to re allocate a new instructor. If another instructor cannot be made available any monies paid will be refunded minus lessons.

4. Tests:

4.4 Should you fail to reach a satisfactory standard of driving and are likely to be a danger to other road users, or in an unfit condition through drug/alcohol abuse as described in section 1e above, your driving instructor has a responsibility to the DVSA examiners not to allow the use of the training vehicle for the purpose of the driving test. The DVSA guidelines do not allow for a pupil to take a practical test just for the experience.

4.5 No responsibility can be accepted for tests cancelled by the DVSA for whatever reason. Lessons should be paid for but can be claimed back from the DVSA.

4.6 No responsibility can be accepted for a failing a test due to being unable to pass the eyesight test.

4.7 Your instructor will accept responsibility if the test is cancelled due to the condition of the tuition vehicle.

4.8 Where Pass Drive are booking a test on your behalf we will book the earliest date possible providing your instructor agrees that you are ready. We cannot guarantee that a test date that suits your requirements will be found.

5. Intensive Courses:

5.1 Intensive courses range from 10 to 40 hours. An assessment lesson is recommended to determine the length of course required. This will be an estimate and cannot be deemed as guaranteed as it is not possible to anticipate any difficulties that may be experienced during training.

5.2 If an assessment lesson is not possible the pupil should determine the course they require based on the national average figures. (45 hours of professional tuition plus 22 hours of private practice) Where a pupil has had no previous experience we recommend a minimum 40 hour course.

5.3 In order to be able to book a practical test for the end of the course, you will need to have passed your theory test. Pass Drive can book this on your behalf if required.

5.4 Courses will generally be booked around test availability, however, courses can still go ahead even if a test cannot be found to suit. We will continue to search for a test closer to the selected date.

5.5 At the time of booking your course a £100 non-refundable deposit will be required. On receipt, a schedule will be discussed and a test will be booked.

5.6 The balance of the course is due 21 days before commencement. After this time this becomes non-refundable.

5.7 The total cost of an intensive course includes the practical test and the use of the car for the test. For example; A 20-hour course will have 18 hours tuition, 1-hour pre-test lesson and the car for the test.

5.8 Pass Drive cannot guarantee that you will be at a suitable standard to go to test at the end of the course. If you are not of a suitable standard, the instructor reserves the right to withdraw the use of the training vehicle for the test.

5.9 No responsibility can be accepted for tests cancelled by the DVSA for whatever reason. Should the DVSA cancel your test ahead of the course start date, or during your course, we will rearrange your test for the next agreeable date.

6. Residential Courses: 

As intensive courses plus;

6.1 Bed and breakfast accommodation is included in the overall price shown. Accommodation will be the best available at the time of booking.

6.2 Pupils should budget for lunch and dinner. (Lunch will generally be taken in the car in the form of a snack/packed meal)

6.3 If extra hours are required, your instructor will help you with additional hours where possible, however, this can not be guaranteed. Payment for the extra hours will be due prior to commencement.

6.4 No responsibility can be accepted for tests cancelled by the DVSA for whatever reason. Should the DVSA cancel your test ahead of the course start date, we will rearrange your course, accommodation and test for the next agreeable date. If this occurs during the course, we cannot accept responsibility for travel expenses.

7. Gift Cards

7.1 All electronic Gift Cards are valid for a period of 6 months, from the date that they are sent via email. This date will be displayed on the Gift Card. It is the responsibility of the recipient to redeem the Gift Card within the six (6) month period. The Gift Card can not be redeemed once this period has passed and will be void.

7.2 All electronic Gift Cards are in pounds sterling (£), which can be redeemed for driving lessons with Pass Drive Ltd instructors.

7.3 All electronic Gift Cards must be redeemed through Pass Drive Ltd directly and can be redeemed by contacting us by phone or email. You must provide us with your unique code to redeem your gift card.

7.4 All electronic Gift Cards are available for new drivers only, see paragraph 2.6 for further details. For experienced drivers, please contact us directly, we may be able to create a package.

7.5 Gift Cards can only be used to redeem driving lessons with Pass Drive Ltd and can not be exchanged for a monetary value.

7.6 Should you lose your electronic Gift Card, Pass Drive Ltd is unable to provide you with a replacement, or reimburse the value of the Gift Card.

7.7 Personal Data relating to the purchase or use of an electronic Gift Card will be used in accordance with current applicable data protection and privacy legislation, and our privacy policy which can be found at https://www.pass-drive.co.uk/privacy-policy-2/

8. Trailer Training Courses:

8.1 Trailer training and towing courses range from 1 day to 4 days. A suggestion will be provided based on your experience to determine the length of course required. This will be an estimate and cannot be deemed as guaranteed as it is not possible to anticipate any difficulties that may be experienced during training.

8.2 Courses will generally be booked around test availability, however, courses can still go ahead even if a test cannot be found to suit, or if a test is not required due to Acquired Rights(Grandfather Rights).

5.5 At the time of booking your course a £100 non-refundable deposit will be required. On receipt, a schedule will be discussed and a test will be booked.

5.6 The balance of the course is due 21 days before commencement. After this time this becomes non-refundable.

5.7 The total cost of a trailer training and towing course includes the practical test and the use of the car and trailer for the test. For example; A 1.5-day course will have 6 hours of tuition, 1-hour pre-test lesson and the car and trailer for the test.

5.8 Pass Drive cannot guarantee that you will be at a suitable standard to go to test at the end of the course. If you are not of a suitable standard, the instructor reserves the right to withdraw the use of the training vehicle for the test.

5.9 No responsibility can be accepted for tests cancelled by the DVSA for whatever reason. Should the DVSA cancel your test ahead of the course start date, or during your course, we will rearrange your test for the next agreeable date.
